3. Scope of Service (Non-Marketplace Clause)

ShadowSkins operates exclusively as a retailer of digital goods.

  • Retail Model: We sell skins directly from our own inventory to the User.
  • No Marketplace Functionality: The Website does not function as a marketplace, peer-to-peer (P2P) trading platform, or auction house. Users are strictly prohibited from attempting to list, advertise, or sell their own items through our interface.
  • Inventory Limitation: Our service is limited to the purchase of available stock held by the Company.

4. User Eligibility and Account Obligations

By using the Website, you represent and warrant that:

  3. Your Steam account is in good standing and is not subject to any trade restrictions, bans, or community suspensions.

5. Purchase and Payment Terms

5.1. Pricing and Currency

All prices displayed on the Website are subject to change without notice. Prices are listed in the currency specified on the product page. The Company reserves the right to adjust pricing based on market fluctuations of digital assets.

The delivery of Skins is performed via the Steam Trade system. The success of this delivery depends heavily on the accuracy of information provided by the User.

6.1. Mandatory Requirements for Delivery

To ensure successful delivery, the User must:

  • Provide a valid, active, and publicly accessible Steam Trade URL.
  • Ensure that their Steam Inventory visibility is set to "Public".
  • Ensure that their account is not currently in a "Trade Cooldown" period imposed by Steam Guard.

6.2. Disclaimer of Delivery Failure

ShadowSkins shall NOT be held liable for any failure to deliver skins resulting from:

  • An incorrect or expired Trade URL provided by the User.
  • The User’s Steam inventory being set to "Private".
  • Any trade restrictions, bans, or technical locks on the User's Steam account.
  • Delays caused by the Steam API or Valve Corporation infrastructure.

7. Prohibited User Conduct

Users agree that they shall not engage in any activity that:

  1. Interferes with the security, integrity, or performance of the Website.
  2. Utilizes automated software (bots, spiders, scrapers) to harvest data from our inventory or pricing.
  3. Involves fraudulent activities, including but not limited to "Chargeback Fraud" (disputing a legitimate transaction after receiving the item).
  4. Violates any local, national, or international laws or regulations.

Violation of these terms may result in the immediate termination of your account and the forfeiture of any pending orders.

8. Intellectual Property Rights

All content on the Website—including but not limited to text, graphics, logos, images, and software—is the exclusive property of ELAYWAVE Sp. z o.o. or its licensors. 10. Limitation of Liability and Indemnification

UNDER NO CIRCUMSTANCES SHALL ELAYWAVE SP. Z O.O., ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. This includes, but is not limited to, loss of profits, loss of digital assets (Skins), loss of data, or any damages arising from the use of or inability to use the Website, even if we have been advised of the possibility of such damages.

10.2. Indemnification

You agree to indemnify, defend, and hold harmless ELAYWAVE Sp. z o.o. and its officers from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in any way connected with:

  • Your use of the Website or your violation of any third-party rights.
  • Any dispute regarding your Steam account or Steam trade history.

11. Termination of Service

The Company reserves the right, in its sole discretion, to terminate or suspend your access to the Website and all services without prior notice or liability, for any reason, including but not limited to a breach of these Terms or suspected fraudulent activity.

12. Force Majeure

ShadowSkins shall not be liable for any failure or delay in performing its obligations under this Agreement if such failure or delay is caused by events beyond our reasonable control, including but not limited to: acts of God, war, terrorism, labor disputes, pandemics, or significant technical outages/updates within the Steam platform or Valve Corporation's network.

13. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Poland. Any legal action or proceeding arising under this Agreement shall be brought exclusively in the competent courts located in Warsaw, Poland.
